Terms of Service

The agreement between you and Elevated. Last updated 22 May 2026.

These terms govern your access to and use of ElevatedOS and related websites, applications, and services (the “Service”), provided by Elevated (“Elevated”, “we”, “us”). By using the Service, you agree to these terms. If you do not agree, do not use the Service.

Who can use the Service

You must be at least 18 and able to enter into a binding agreement. If you use the Service for an organization, you confirm you are authorized to accept these terms on its behalf.

Your account

You are responsible for the activity under your account and for keeping your sign-in access and any agent tokens secure. Tell us promptly if you believe an account or token has been compromised; you can revoke agent tokens at any time from Settings.

What the Service does — and does not — do

ElevatedOS helps founders measure founder dependency and design an operating rhythm. It produces diagnostics and recommendations. Every recommendation is yours to approve, edit, or reject. The Service does not take external actions on your behalf — it does not send, publish, spend, or transact without your explicit action.

The Service’s content and AI output are for general business and informational purposes. They are not legal, financial, tax, medical, or other professional advice, and are not a substitute for your own judgment or for qualified professionals.

Payments and refunds

Paid products are sold through our merchant of record, Polar, which processes payment and applicable taxes. Prices are shown at checkout. Unless stated otherwise at the point of sale or required by law, one-off engagement fees are described on the relevant product page, including any refund terms that apply. Where a specific refund promise is made for a product, that promise governs.

Acceptable use

You agree not to:

  • break the law or infringe others’ rights using the Service;
  • attempt to access accounts, organizations, or data that are not yours, or probe, scan, or test the security of the Service without permission;
  • disrupt or overload the Service, including the agent (MCP) endpoint, or evade rate limits;
  • misuse AI features to generate unlawful, harmful, or deceptive content;
  • resell or commercially exploit the Service except as expressly permitted.

Connecting AI agents

You may connect your own AI agent to the Service using a personal access token. You are responsible for what your agent does with your token. Agent access follows the same boundary as the rest of the Service: agents may read your operating model and propose actions into your review queue, and never act without your approval.

Your content

You keep ownership of the information and content you submit. You grant us the limited rights needed to operate and improve the Service for you, including processing your inputs through the providers described in our Privacy Policy. You are responsible for ensuring you have the right to submit the content you provide.

Our intellectual property

The Service, including its software, design, and content (other than your content), belongs to Elevated or its licensors. These terms do not transfer any of those rights to you beyond the right to use the Service as intended.

Availability and changes

We may update, suspend, or discontinue features. We aim to keep the Service available but do not guarantee uninterrupted operation. We may update these terms; when changes are material, we will update the date above and, where appropriate, notify you. Continued use after a change means you accept the updated terms.

Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind to the maximum extent permitted by law. We do not warrant that the Service will be error-free, or that its insights or recommendations will produce any particular result.

Limitation of liability

To the maximum extent permitted by law, Elevated will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.

Termination

You may stop using the Service at any time. We may suspend or end your access if you breach these terms or to protect the Service or other users. You can ask us to delete your account as described in our Privacy Policy.

Governing law

These terms are governed by the laws of South Africa, and the courts of South Africa have jurisdiction, except where mandatory local consumer law gives you other rights.
